In 2008, the Dutch Ministry of Agriculture, Nature and Food Quality commissioned a comparative study into the inclusion of animal ethics in animal welfare policy-making in four European countries. One of those countries was Austria. A small group of experts met in a workshop to investigate research questions provided by the Dutch project in order to outline the current Austrian situation. The results of the working group were presented in a detailed report. It provided information on how ethical principles are represented in the Federal Austrian Animal Protection Act (APA) and what measures have been taken to live up to them. This article gives an overview of the key findings. After a short introduction to the history and the scope of the APA (1), the ethical background of the APA is briefly outlined (2). The introductory part is followed by answers to the four research questions given by the project’s organizers. The first addresses moral principles in animal ethics which are represented in the APA (3). The consecutive section deals with governmental instruments that have been installed to implement the APA and incorporated principles (4). The APA contains a number of measures that are listed and explained. Since not all of them are effectively working, doubts and critical attitudes are outlined where appropriate. Finally, the article focuses on problems and obstacles that hinder the efficient moral and legal consideration of animal welfare in practice (5). The presentation of all results brought together in the report is beyond the scope of this article. Therefore, only specialties such as the concept Mitgeschöpflichkeit (fellow creatures) in its secular, non-theological, meaning and specific Austrian governmental instruments are discussed.
