Abstract

The chapter introduces the innovations and improvements of the Chinese succession system brought by the Civil Code. Compared with the background of the 1985 Succession Law, the level of social development and the total value of social wealth and per capita value in the era of the Civil Code have changed dramatically. The change is clearly bringing out demands for more specific and detailed norms on the disposition of the estate. It should however also be noted that, after more than thirty years of application of the 1985 Succession Law, the majority of the public has already accepted and become accustomed to the existing system of succession. This means that the social cost of changing the existing rules would be great. This explains why the Book on Succession of the Civil Code makes some additions and improvements to the chapters of the 1985 Succession Law, while leaving the succession system basically unchanged.
