Abstract

The chapter focuses on some features of Book I of the Chinese Civil Code that look particularly interesting in the comparative perspective, and especially in relation with the German and the Swiss legal tradition. In particular, the chapter examines the solutions provided by Book I as to statutory interpretation and gap-filling. It then analyses general rules on civil juridical acts and manifestations of intent, as well as the regulation of agency and of the lmiitation period.
