Abstract

This chapter assesses in the comparative and historical perspective the terminology, the structure, the underlying principles, and the provisions on succession law of Book V of the newly enacted Chinese Civil Code. Through the comparative and historical survey, it will become clear that, by merging well-known Western values with Chinese values, Book V belongs to the Roman legal tradition, mixed with Chinese characteristics arising out from both Chinese traditional and socialist background.
