Abstract

The legal systems of India and China, two giants situated in Asia, can be said to be poles apart; while China just adopted a new codification, the Indian legal system does not have a civil code and rather deals with civil law aspects in different laws, under different heads. Yet, when one focuses on specific issues, one easily finds out that similarities do exist. To substantiate this claim, the chapter specifically looks into two aspects and compares their scope under both the legal systems. The first aspect concerns the general structure of tortious liability under the Chinese Civil Code and in India. The second aspect deals with the issue of tortious liability for environmental damage.
