Abstract

Focussing on Book IV of the Chinese Civil Code, dealing with personality rights, the chapter seeks to place its provisions into comparative perspective, contrasting the systematic approach adopted by the Civil Code with the piecemeal development of personality rights protection in other countries. Following a comparative introduction, the chapter emphasizes some of the specific features of the Chinese Civil Code in this field: the allocation of provisions on personality rights to a separate book of the Code, the definition and scope of the notion of ‘personality rights’, the means of their protection, and the remedies provided for their infringement.
