Abstract

The Chinese Civil Code’s General Part is deeply influenced by the structure of its German counterpart. Such an influence can be explained due to many historical factors. The German civil code model has influenced China’s civil law directly or indirectly over a long time. The Chinese Civil Code’s General Part has used the structure of the General Principles of the Civil Law for reference, which is related to the fact that the Chinese Civil Code was codified mainly to reflect continuity and keep the existing legislative achievements that are deemed successful. The chapter underlines the many noteworthy specific contents of the Civil Code’s General Part that reflect the response by legislators to emerging social issues.
