Abstract

The independent Book on Personality Rights is considered by some scholars as an innovation in the compilation of the Chinese Civil Code, which is said to have dovetailed the legislative tendency to strengthen the protection of personality rights, highlighting the legislative value of ‘humanism’, and delineating the content and scope of personality rights. Compared with the situation before the enactment of the Civil Code, the Book on Personality Rights contains a more comprehensive set of provisions covering aspects of delineation of the content and scope of personality rights, establishment of duties to be borne by certain specific persons, the prohibition of various acts constituting infringement upon personality rights and the remedies available to aggrieved right holders, and exemptions to liability available to tortfeasors. Although the goal of highlighting the values underlying personality rights can be said to have been passably achieved, the Book is not satisfactory in terms of the delineation of personality rights, the structural arrangement, and the function of guiding the rendering of judicial judgement.
