Abstract

The chapter examines the challenges affecting the regulation of real rights in contemporary societies and discusses how the civil law and the common law legal traditions are dealing with them. Against this context, the chapter assesses how the newly adopted Chinese Civil Code has addressed such challenges, focussing in particular on the issues of who can be a legal subject, what can be the object of a real right, and which legal relationships may exist between legal subjects regarding an object of a real right.
