Abstract

The chapter discusses the procedure and practice of holding elections in the exceptional situation of the COVID-19 pandemic in a number of European countries in the context of international standards of the right to participate in free elections. The main goal is to answer the following research question: whether and to what extent these elections met the above-mentioned standards? The approach is institutional and is based on the analysis of documents and legal frames and their comparison with particular practices in the electoral process. The main used research methods are institutional-legal and analysis of the content of reports of OSCE missions monitoring elections in European Union states in 2020â2021. The main anticipated finding is reconstruction of international standards for holding free elections in extraordinary and exceptional circumstances of fighting with global pandemic. It is particularly relevant because international human rights law particular individual rights, including the right to free elections, create minimum standards, specific ultima ratio, the violation of which indicates failure to comply with the basic electoral principles.
