This contribution discusses four fairly recent trends in respect of the enforcement of European Union law (hereafter EU law) and the challenges they pose to in particular administrative lawyers like Bernd van der Meulen. The first trend is the centralisation of enforcement at the EU level, resulting from the proliferation of EU enforcement agencies with direct enforcement powers towards private actors. This development poses challenges to judicial protection in particular. The second trend is that the EU regulatory focus on enforcement has clearly shifted from administrative law to criminal law. This focus on criminal law has diminished the EU’s regulatory attention for administrative law enforcement and, as a factual result, innovations that have been introduced in the area of criminal law do not apply to administrative law enforcement. An important innovation – and the third trend in EU enforcement law – is that the EU has created in the area of criminal law a large number of instruments in order to facilitate the EU wide, transboundary enforcement of judgments and judicial decisions. In administrative law comparable instruments do either not exist or are not very elaborated, thus hampering the effective administrative enforcement of transboundary violations of EU law. Therefore, the further development of comparable instruments in the area of administrative law is an important challenge for administrative law research as well. The fourth trend in EU enforcement law is the growing importance of procedural guarantees and fundamental rights. Also, in respect of this trend criminal law is in the lead and may provide inspiration to administrative lawyers.
