The right of public access to information is being protected in most countries of the world. Although this right is far-reaching in theory, there are a lot of statutory exemptions. An important exemption concerns protection of the deliberative process. This means that internal deliberations of government officials are subject to disclosure only to a limited extent. In this contribution, a closer look will be taken to background and meaning of the concepts of access to information and of protection of the deliberative process. In a comparative approach, three statutory systems of public access to information – that of the Netherlands, the United Kingdom and the United States – will be examined, in order to find out whether and to what extent the deliberative process is protected, and which similarities and differences can occur in legislation and in case-law. Special attention will be paid to the question whether the protection of the deliberative process also extends to communication with external parties.
