Abstract

This chapter examines the role of the European Union (EU) (as an international organisation (IO) under international law), and whether its existence and activities have been relevant for the development of the international law of the sea, in terms of addressing and repressing maritime piracy, with a focus on Article 100 of the 1982 United Nations Convention on the Law of the Sea (LOSC). In doing so, this contribution looks at relevant EU practice and activities in the Gulf of Guinea (section 3) and off the coast of Somalia (section 2). Through its conduct, approaches, and activities (mainly by having a naval presence in these two areas of the world), the EU can be said to have contributed to the regulation of maritime piracy, and more specifically the interpretation and implementation of Article 100 LOSC (section 4). The EU has taken a different approach when it comes to repressing piracy off the coast of Somalia and in the Gulf of Guinea. The EU’s approach off the coast of Somalia has been characterised by its ‘comprehensive approach’, while the EU’s new ‘Coordinated Maritime Presences concept’ was introduced in the Gulf of Guinea context. However, both approaches of the EU can be seen to have contributed to the development of the understanding, interpretation, and implementation of Article 100 LOSC, which enshrines the obligation to cooperate in the repression of piracy.
