Abstract

Cooperative obligations of States as regards marine capture fisheries, including high seas fish stocks, are nowadays usually operationalized through Regional Fisheries Management Organizations (RFMOs) and Regional Fisheries Management Arrangements (RFMAs). This chapter reflects on their role and contributions to the law of the sea, ever since the 1982 Law of the Sea Convention (LOSC) entered into force, some thirty years ago. These two institutional bodies are assessed through the thematic lens of âThe Good, the Bad, and the Uglyâ, the title of Sergio Leoneâs classic 1966 movie, starring Clint Eastwood. RFMOs and RFMAs possess the mandate to establish conservation and management measures for marine capture fisheries within their jurisdiction. Studies on the current state of marine capture fisheries make for grim reading, with the general picture emerging that many stocks are in dire straits. This has led to that the raison dâetre of RFMOs and RFMAs has been questioned. And more trouble lies ahead for RFMOs and RFMAs with the additional challenges climate change will present, which will put their raison dâetre further to the test.
