Abstract

The purpose of this article is to outline the contribution of Latin American and African regional organisations and fora to the development of the law of the sea. In the context of the Third United Nations Conference on the Law of the Sea (UNCLOS III), their main contributions concerned some innovative parts of the Montego Bay Convention (UNCLOS), such as the new concepts of the Exclusive Economic Zone (EEZ) and the regime of the seabed, the sea floor and its subsoil beyond the limits of national jurisdiction. The article also examines the subsequent practice related to the implementation of UNCLOS in the Latin American and African context and the original developments in the law of the sea that emerged in the following decades. Finally, some observations are made on the crucial role played by Latin America and Africa during the Intergovernmental Conference on the creation of an international legally binding instrument for the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction.
