Abstract

People of African descent have lived in what is now Latin America since the beginnings of Spanish and Portuguese contact with the region. Brought to the Americas as slaves, Africans and their descendants were initially governed by slave codes that often sanctioned harsh treatment, but also provided some protections for slaves including the right to marry and to purchase freedom.

Slavery would end in the nineteenth century with the last emancipation occurring in Brazil in 1888. The constitutions of the independent nations of Latin America recognized the equality of people of all races before the law, but that recognition often masked significant racial discrimination in the region. State sponsored racial discrimination was most glaring in the field of immigration law with a number of nations adopting legal provisions prohibiting immigration by people of African descent. In the twenty-first century a number of nations have strengthened anti-discrimination law or adopted affirmative action policies to remedy long entrenched patterns of racial discrimination.
