Abstract

Historians of empire have tended to describe legal pluralism as a particularly colonial affair. This text explains why this was not the case by examining the nature of the early modern state in both Europe and its overseas domains. It then follows by surveying early modern legal pluralism in colonial Latin America and explains efforts, only partially successful and often with detrimental effects, to remove pluralism with the coming of independence. It ends by analyzing the most recent developments, which feature attempts to re-institute the rights of certain groups to their own law as applied by their own authorities. These attempts, mostly concentrating on ethnic groups, tend to discriminate against Afro-Latin Americans, who rarely enjoy the same rights. The questions of how equality can persist despite differential treatment and how consensus could be achieved despite divisions are significant challenges Latin American pluralistic legal systems face today.
