Abstract

The fate of Latin American law after 1930 has been, to a significant extent, closely intertwined with different waves of state-led institutional change envisioned to overcome socio-economic ‘underdevelopment.’ In this light, the chapter provides an interpretive account of how law played a significant role in three streams of reforms aiming to ‘modernize’ Latin American societies: populist regimes, radical political projects in the context of the cold war, and the economic and social liberalization of the late-twentieth century. Hence, the most salient legal phenomena of the period are explained as scaffoldings of successive programs of ‘modernization’ contending with each other in the region.
