Abstract

This chapter traces the general evolution of ‘social states’ in Latin America from the first expressions of social policies to the construction of contemporary welfare states. Following developments in recent historiography, the accent is placed on the weight of the transnational circulation of doctrines and institutional mechanisms and on the construction of networks of experts, bearers of new ‘social knowledge’ and drivers of social policy models. Particular attention is given to processes of circulation of legal doctrines and their inscription in constitutional texts and legislation that served as intellectual support for this evolution. This perspective is of particular importance for approaching the construction of the welfare state from the point of view of legal history, as a complement to the predominance of studies coming from the social sciences-economics, political science, sociology – in the existing literature on the subject.
