Abstract

In the area of environmental protection, the tension between trade and regulatory measures taken to protect the population from certain risks (e.g. sanitary and phytosanitary risk) has led to an extensive discussion under a broad title “Trade and Environment”. The chapter deals with the regulation of treatment of trade in hazardous waste, as an example of a situation where the protection of consumers, the environment and the public in general requires government action. The author analyzes the relevant provisions of the Basel Convention and its compatibility with the WTO legal framework.
