Abstract

International trade is based on an efficient transport system. The chapter analyzes the legal framework for rail transport through the Eurasian region (from China to Europe), which is characterized by two international organizations (OTIF and OSJD) with differing legal provisions for transport (CIM and SGMS). Starting with the overall background of WTO law, in particular its Trade Facilitation Agreement, the contribution then addresses recent developments as to electronic consignment notes and the common CIM/SGMS consignment notes and the relationship between CIM/SGMS and the special rules of postal transport under the Universal Postal Convention.
