Abstract

This chapter reviews foundational and recent literature on women and the law in Latin America from the colonial era to the present. The works discussed here address how the various legal regimes categorized and treated women, and how women, in turn, utilized and resisted legal systems. Women were not treated as a monolith within Latin American societies, and these contributions underscore the unique experiences of wives, enslaved women, and mystics, among others. The first half of this discussion examines the competing legal systems of the colonial era. In the second part of the chapter, I highlight works that show how independence and state-making affected women’s place within new legal realms. For both eras, the scholarship illuminates how the law proved inequitable for women. This historical research has also demonstrated how women’s legal activity could advance their own causes and reshape the law itself.
