Abstract

Much has been written about the evolution of commercial law in general and in Latin America in particular. Commercial law had from its origins, in the Late Middle Ages, a high degree of autonomy and specialty. Merchants were associated in large professional corporations that received the name of Consulates and had as their function the defense of the economic interests of their members. The first Consulate in Castile was in Burgos consulates in Bilbao and Seville followed. In New Spain, on 1592, the association charter of the first Spanish-American mercantile guild was issued. The next Indies Consulate was that of Lima, which was incorporated by decree of 1593, although it did not begin its corporate life until 1613. As for commercial doctrine, it was not until the sixteenth century that professional jurists paid more attention to commercial problems. The jurists of the mos italicus who wrote about commercial law were Benvenuto Stracca, Sigismund Scaccia, Carlos Targa, Ansaldo Ansaldi, and Francesco Rocco. Later we will see works such as that of Giuseppe Lorenzo Maria Casaregi. After the independence of the Ibero-American nations was achieved, the early eighteen century Ordinances of Bilbao became the body of trade laws that governed in Ibero-America. They remained in force until the respective promulgation of the commercial codes.
