Abstract

This chapter covers countries of Latin America which share the experience of having been part of the Spanish and Portuguese empires until the early nineteenth century, except for Cuba that became an independent country in 1901 and Puerto Rico that is a part of the United States. The essay concentrates on the largest and most populous Spanish and Portuguese speaking countries (Argentina, Brazil, Chile, Colombia, Mexico, Peru, and Venezuela) because of the paucity of scholarly information on the legal education and legal profession in the other countries. More exactly, the Spanish speaking countries of this study were legally ‘kingdoms of the Crown of Castile.’ This distinction is not irrelevant because Castilian law was applied and because the link to this Crown, and not to Spain as a nation, was very important for the independence movement.

This study addresses legal education and the legal profession. Spain and Portugal are countries within the civil law tradition where legal education involves formal study at a university. Only people with a university legal education are recognized as lawyers, even if in some periods of the history of Latin American some non-lawyers were authorized to practice law. In this chapter the focus will be lawyers and, specifically, the people: who were the students and, later, the lawyers? what were their knowledge and skills? and what was their role in society?
