Certain rules stated in the ICJ’s jurisprudence favour the assertion of jurisdiction over time. Events occurring after the filing of the application do not affect jurisdiction negatively, while jurisdiction may arise after the application, provided that it relates to a dispute existing when the application was filed. Another rule favours jurisdiction with regard to counter-claims. The same applies to the requirement of prima facie jurisdiction for the adoption of provisional measures.
