When conferring jurisdiction to international courts and tribunals, States voluntarily accept to become subjects to dispute settlement proceedings, but within the limits – including time limits – provided for by their jurisdictional agreement. Part XV of UNCLOS sets out a “compulsory” dispute settlement mechanism, giving parties the choice between different procedures, including the International Tribunal for the Law of the Sea (ITLOS). When cases are submitted to ITLOS, several temporal aspects must be taken into account in conformity with UNCLOS’ prescriptions. Whether they constitute fixed delays or “reasonable” periods of time, whether they concern access to ITLOS, its jurisdiction or the possibility for the parties to choose another court or tribunal for prompt release and provisional measures claims, the temporal factors examined in this contribution are essential in the dispute settlement proceedings provided for by UNCLOS. Their interpretation and application by ITLOS will therefore be examined.
