Evolutive interpretation is a condition for the adaptation of several international treaties over time, including the ECHR. Such an interpretative method is widely accepted, nowadays, as reflecting the presumed will of the contracting parties. However, evolutive interpretation has its limits: it cannot be contra legem, it must be in conformity with the object and purpose of the Convention, and it is confined to reflecting present day conditions, not future ones. The ECtHR continuously refines its methodology to establish “European consensus” as a form of “subsequent state practice”. It does so with a view to taking an informed and solidly motivated decision to go for an evolutive interpretation or not. In the same vein, the Court streamlines its dialogue with other international bodies; carefully selects the “relevant rules of international law”; and has changed the structure of its judgments to better highlight the various elements of international law and practice taken into account when interpreting the Convention.
