The long-standing nature of the agreements that form the WTO legal system, the dynamicity of trade law and the legal interaction between the regimes established by the GATT 1947 and the 1994 WTO Agreement raise interesting questions that can be better grasped through an ‘intertemporal’ prism. Against this backdrop, this paper provides an overview of different aspects concerning the impact of time in the interpretation of GATT Article XXI. The paper examines recent WTO Panel reports, focusing on three aspects that connect ‘time’ and the interpretation of Article XXI: the use and relevance of the provision’s drafting history, the resort to subsequent agreements or subsequent practice and evolutionary interpretation. These questions, to some extent self-standing, are interrelated insofar as they partly emerge from the fact that Article XXI dates back to 1947, interacting with a legal framework established subsequently and is being interpreted and applied many decades later.
