Time affects investor-State dispute settlement in multiple ways. The most apparent and impactful is the duration of investment treaty arbitration, which concerns not only the parties to an individual proceeding, but also proponents and critics of the system as a whole. This article reviews several quantitative studies which suggest that individual phases and entire proceedings are growing longer. It then examines various reasons why that might be: their inherent complexity, arbitrator challenges, annulment proceedings, and other reasons. Finally, the article surveys several responses to the challenge of duration, including the new Code of Conduct for Arbitrators in International Investment Disputes, the 2022 ICSID Arbitration Rules revision, and other expedited procedures. The article aims to cast familiar issues in a new light, as well as provide guidance on how to manage duration.
