Abstract

In recent decades, Carl Schmittâs controversial legacy has regained prominence in international law, often through separating his political commitments from his supposed insights into its history and nature. This chapter challenges that separation and Schmittâs canonization as a theorist and historian of international law. By critically analysing his political narration of international lawâs history and his appropriation of Francisco de Vitoria, we reveal Schmittâs unscholarly and political aims. His use of Vitoria constructs a historical narrative that both echoes far-right revanchist views and serves as an apologetic account of his involvement with the Nazi regime.
