Abstract

This chapter examines the ambivalent reception of Francisco de Vitoria in the history of international legal thought. It focuses on two prominent interpretations: Jürgen Habermas, who highlights Vitoria’s proto-democratic concept of dominium and his vision of international law as a framework among equal political communities, and Martti Koskenniemi, who emphasizes Vitoria’s role as a pragmatic advisor whose flexible use of ius gentium justified imperial expansion. The contrast illustrates how the same texts can serve radically different projects: one underpinning democratic constitutionalism, the other enabling apologetic economic liberalism. The chapter attributes this divergence to the limited and inconsistent textual corpus, as well as to the open-ended scholastic method, which fosters ambivalence between universalist and particularist readings. Ultimately, it situates Vitoria at the crossroads of systematic and critical approaches, revealing both the constructive potential and the inherent indeterminacy of international legal imagination.
