Abstract

Spatiality is a major recurring theme in the history of Chinese engagements with international law. Often, this theme has manifested in the tension between advocacy of universal norms or institutions and the countervailing stance of asserting state sovereignty. Ideas of natural law have been invoked to support both universal norms and sovereign rights, which contribute to significant overlap between Chinese discourse and the claims of leading Western ‘naturalist’ theorists of international law. A fruitful comparison can be drawn between the writings of Francisco de Vitoria and other members of the School of Salamanca to China’s later defenses of universal norms justifying anticolonial solidarity. Meanwhile, the work of Carl Schmitt, in which natural law-inflected arguments support the sovereign power of the state and the formation of autonomous regional orders, also has echoes in aspects of China’s legal stances. One way to interpret key policy-oriented legal platforms of the People’s Republic of China, such as the Five Principles of Peaceful Coexistence and the more recent Community of Shared Future of Humankind, is to see them as vehicles for mediating different strains of thought about the ‘natural’ spaces of international law’s binding force and its limitations.
