Abstract

It is widely recognised that restorative justice has many definitions involving the reparation of harm, victim satisfaction with the outcome, an element of reintegrative shaming and the opportunity to rebalance the relationship between victim and offender. It is also often mistakenly thought that restorative justice within a Westernised setting has its origins only within the last half of the twentieth century. This chapter looks at a particular historical activity; the use of many thousands of printed public apologies in late-eighteenth and early nineteenth century British local newspapers that the chapter contends to be seen as an early and discrete type of restorative justice. Such printed apologies were victim-instigated, they often saved the offender from a custodial sentence, there was an element of reintegrative shaming, and they ultimately enabled both victim and offender to reach a mutually satisfactory rapprochement without resorting to the utilisation of a deeply flawed official criminal justice system. It begins with a descriptive element of research carried out in this field before moving on to a didactic discussion of how such research can be undertaken and ends with a conceptual reflection on how such historical research can be used to further current understanding of the complex field of restorative justice. It is intended to highlight a previously under-researched topic that through the practice of historical criminology can be used to reflect on modern-day practices of both restorative justice and shaming.
