This chapter focuses on the International Court of Justice (ICJ) and the relationship between its incidental proceedings and the temporal aspect of contentious proceedings. By focusing on three particular incidental proceedings, namely provisional measures, intervention, and preliminary objections, the chapter conceptualizes incidental proceedings as facilitating (i) the weaving of new elements into proceedings through provisional measures (ii) the prolonging of proceedings through the introduction of different interests by intervening parties, and (iii) cutting short or dispensing with claims through the making of preliminary objections. In doing so, the chapter shows that the Court’s existing incidental proceedings allow the temporal aspect of proceedings before it to be shaped and reshaped in ways that have the potential to transform the essence of the proceedings. The chapter ends on a cautionary note with regard to such transformation, calling for the Court to not allow the essence of the case to be completely modified despite the impact of incidental proceedings on the temporal character of proceedings before the Court.
