This chapter provides a detailed analysis of the time factor in deciding whether at all, and if so when, to bring a case before the International Court of Justice (‘ICJ’). It first shows that the timing of filing cases with the Court is strongly influenced by political considerations. It then goes on to demonstrate that the time element has an impact on the status of a potential party to a conflict. The study reveals that the requirement of the existence of a dispute is inextricably linked to the time factor. It further analyses the temporal requirements contained in both, compromissory clauses, as well as in declarations under Art. 36(2) of the Statute of the ICJ (‘ICJ Statute’), as well as in the termination of such declarations, respectively the withdrawal from treaties containing compromissory clauses. It then further considers the temporal scope of Art. 36(2) declarations and compromissory clauses. Finally, it discusses the standing ratione temporis in the case of erga omnes partes obligations.
