Abstract

A critical question in the child rightsâ discourse is the extent to which the African Committee on the Rights and Welfare of the Child (African Childrenâs Committee) continues to interpret and offer jurisprudential guidance to the enjoyment of socio-economic rights. This chapter sets the scene on the African Childrenâs Charter and socio-economic rights (SERs) and, later, evaluates two decisions in Minority Rights Group International and SOS-Esclaves on behalf of Said Ould Salem and Yarg Ould Salem v Mauritania and Institute of Human Rights Development in Africa v Cameroon. This leads to an evaluation of the use of the due diligence principle as an arsenal for the continental mechanism. A conclusion follows thereafter.
