Abstract

Following the initial detection of the Coronavirus (COVID-19) in Africa on 14 February 2020, in Egypt, it became evident that the continent faced significant challenges in both containing the spread of the virus and addressing the socio-economic repercussions of containment measures. Given Africa’s predominantly impoverished population, many of whom rely on informal employment and lack the option to work remotely, the COVID-19 pandemic precipitated an acute crisis of hunger in numerous African nations. This crisis stemmed directly from poverty, with the surge in poverty levels paralleling an increase in the number of individuals experiencing hunger. Even before the onset of the pandemic, Africa grappled with alarming rates of hunger, food insecurity and malnutrition, particularly among children. COVID-19 exacerbated this vulnerability, amplifying the urgency of addressing food insecurity across the continent. This paper critically examines the right to food for children in Africa during the COVID-19 pandemic, focusing on South Africa as a case study. By analysing the legal framework and enforcement mechanisms surrounding the right to food, this study draws insights from the landmark case of Equal Education v Minister of Basic Education in South Africa. Through this case, the South African approach to realising children’s right to food is scrutinised, highlighting the complex interplay between governmental accountability and the roles of various stakeholders in ensuring food security. The analysis underscores the imperative for holistic and collaborative efforts, as enshrined in the African Children’s Charter, to address the multifaceted challenges posed by food insecurity among Africa’s children, particularly in the context of the COVID-19 pandemic.
