Abstract

This chapter discusses the potential of the African Committee of Experts on the Rights and Welfare of the Child (African Children’s Committee) to contribute to the understanding of children’s right to health in Africa. In doing this, the chapter focuses on the opportunities available to the African Children’s Committee in providing clarification to the nature and content of this right for better understanding by African states. The chapter begins with a detailed discussion of Article 14 of the Charter, which provides for child rights to health and health services, highlighting its unique features. It then discusses the interpretation the African Children’s Committee has provided to clarify this provision. This discussion is carried out by examining the promotional and protective mandate of the African Children’s Committee. The chapter highlights the role of the African Children’s Committee in advancing the right to health of children in the region. It further assesses the mandate of the Committee and its relevance for realising the right to health for children. It provides some concrete recommendations that African governments should adopt in order to realise the right to health of children.
