Abstract

The article examines two different concepts used to analyse the legal approach to religious communities: autonomy, which represents the general starting point in American law and parts of European law on religion—often leading to parallel legal systems—and intertwinement, a concept that captures how Northern European countries have sought to keep both religious and non-religious organisations and individuals governed under a unified legal framework. The intertwinement approach is traditionally associated with a pragmatic effort to balance global and local secular and religious norms within a single set of legislation.

The paper analyses a specific piece of legislation from 2021, aimed at reducing discrimination against LGBTI individuals, and reveals how conservative Christian groups attempted—and to some extent succeeded—in influencing the legislation towards a more pragmatic direction.

Based on this analysis, the article explores which of the two competing trends is likely to prevail: a modern approach rooted in intertwinement, striving to maintain societal cohesion under a single legal framework, with unified executive and judiciary systems; or an anti-modern, global tendency to fragment the population into distinct groups, each governed by its own autonomous legal systems, norms, legislative processes, and judicial powers, including those shaped by different religious communities.
