Abstract

Many treaties providing for investment arbitration require a notice of dispute followed by a waiting period for amicable settlement. Tribunals disagree on the procedural or jurisdictional nature of this requirement. Tribunals are flexible in accepting additional claims provided they are a factual extension of or are related to the dispute as notified. The ICSID Convention provides for a tribunal’s jurisdiction over additional claims or counterclaims provided they are within the scope of the parties’ consent to arbitration and are otherwise within ICSID’s jurisdiction.
