Abstract

The doctrine of res judicata is recognized by a preponderance of legal systems worldwide and it is considered a general principle of international law. Notwithstanding the general consensus regarding the broad contours of the doctrine and its established standing as a principle of international law, there would seem to be little guidance, other than in the decisions of tribunals which have had to grapple with the issue, as to how specifically it is to be applied by arbitral tribunals and, in particular, by investor-State tribunals. This paper analyses how the doctrine of res judicata has been applied by international arbitral tribunals in the context of both international commercial and investment arbitrations, by reference to international arbitral awards which offer substantive guidance based upon international jurisprudence and doctrine.
