Abstract

This essay examines conflict and judicial processes in the collection of model documents from Visigothic Spain known as the Formulae Visigothicae (FV). Only a few of the texts in this collection concern conflict. Nevertheless, they are enough to reveal what their subjects thought about wrong and some ways they could seek redress. We see some of the concrete steps they could take and resources both legal and personal they could draw on for help. We see some different contexts in which documents were produced, and thus learn something about the role played in disputes by the texts that record them. More difficult is saying for certain what world we are looking at. The FV survive only in a sixteenth-century copy of a twelfth century manuscript from Oviedo. While the texts themselves are Visigothic in origin, it is hard to be more specific than that; nor can we say for sure when they were collected and organized into a formula collection. Formulaic material echoing the FV appears in charters from the Christian north of Spain from the mid-ninth century through the tenth and eleventh; dossiers of formulas containing at least some of our texts were therefore circulating in the region. One such dossier survived in Oviedo long enough to be copied and transmitted to us. This gives us a spectrum of possible times and places to which the images of conflict in the FV could apply.
