Abstract

Catalonia preserves a large number of documents from the ninth to eleventh centuries, probably around 15,000. Of the c. 12,000 documents listed in the PRJ database, 557 are dispute records (between originals and copies), a figure rising to 786 if we add documents of which summaries or extensive registers have been preserved. Most of the Catalan documents were preserved in ecclesiastical archives, although the old comital archive in Barcelona was also very important. Cartularies were compiled by cathedrals, monasteries and the royal chancery, although some of the richest have been lost. This documentation throws light on many aspects of social history, and especially on landholding. The extant dispute records deal mostly with civil matters, especially property disputes, with only a small number addressing criminal cases (homicide, robbery, adultery). The typology of dispute records is very diverse: trial records, testamentary publication charters, records of sworn oaths of witnesses, bipartite agreements (convenientiae), quitclaims (definitiones), procedural guarantees, memorials of complaint (querimoniae), settlements (pacificationes), reconstructions of lost documents (reparationes scripturarum), judicial sentences, and records of arbitration. The richest and most original documents are the memorials of violent acts, the records of judicial disputes over matters of landholding and rent within large estates, the testamentary publication charters and the judicial reconstructions of lost deeds. Also interesting are the documents that inform us about credit practices and foreclosures.
