Abstract

Castile has the smallest number of documents of any region in northern Iberia before 1100, with only approximately 1000 documents. This documentation has been transmitted basically in cartularies, also the 61 dispute records extant for this period, which are largely copied in the cartularies of six monasteries: Cardeña, Oña, Santa María del Puerto, Valpuesta, Santillana, and Covarrubias. The information about disputes is, in general, very fragmentary, and it can be found in different documentary formats. The exceptionally rich Cardeña collection is used in this chapter as a sample for assessing the Castilian corpus of dispute records. A case is made that the motives for recording information about disputes in different ways are more complex than previously assumed. An analysis combining documentary form with other variables shows that disputes between monastic institutions and local communities over landed resources and basic means of production, such as water and mills, have been recorded in the form of narrative accounts and pacts-agreements; that lawsuits over the inheritance of priests, opposing their alleged heirs and the institutions claiming to be the beneficiaries of such inheritances, have come down to us in the form of records of confession and oath; and, finally, that records of judicial transactions arise primarily from the punishment of crimes.
