Abstract

The dependency of judges on fact-finding officers with special competency is well-illustrated in this article about a unique South African court, the Childrenâs Court, instituted in 1937, long before the era of childrenâs human rights and the right to representation. Provision was made for mandatory representation for the child and the parent opposing removal of the child. These representatives were court assistants, trained as social workers, whose task was to control the evidence brought to the judge by child welfare investigators. This article explores the fate of these assistants over time and presents dilemmas facing them because of the new constitutional right to legal counsel. The judgesâ haphazard implementation of the constitutional obligation has led to confusion in the role of these key non-judicial officers in realizing childrenâs and parentsâ human rights.
