Abstract

Applying the concept of the “semi-autonomous social field” (Sally Falk Moore) to the first instance court milieu in Burundi, this article deals with the legal setting as a behavioral concept. Getting a state court to accept a complaint as admissible has little to do with the substance of the case. It has more to do with a power struggle between the local executive political party, which offirs access to adjudicate, and the state court. Added to this is the litigants’ view of themselves as a network of interests and not just individuals. Hence, forum has more importance than the norms. A case study illustrates how the decision of court personnel to adjudicate the conflict and legitimate judicial repute and power is taken on the basis of pre-colonial judicial structures and relationships despite colonial suppression of these structures. Much depends on the motives of court personnel — whether they feel dependent on the executive for career advancement, or feel loyalty to the pre-colonial tradition in which the bashingantahe (pre-colonial judges, reduced to arbitrators) struggled to maintain autonomy so that legal-moral norms could prevail over political interests. The power to mediate between state power and the populace is seen as the key to successful access to justice.
