Abstract

This article analyses the transformations of patterns of access to Native and Sharia Courts over a period of more than so years in DÄr Bidayriyya (Kordofon) in Sudan. The author illustrates how colonial interference in patterns of access to justice, motivated by objectives of revenue collection and military security, can upset political power balances. This in turn can evoke pluralistic responses from litigants in their efforts to adjust to the new power order. The result is a reconceptualization of extrajudicial jurisdiction (based on consent of litigants) and judicial settlement (by force of state power) as well as a redefinition of individual vis-Ã -vis collective responsibility for criminal and civil law transgressions.
