Abstract

This paper maps the current Pacific legal architecture around anti-corruption in the Pacific and its relationship with the global anti-corruption framework. It assesses the extent to which the Pacific regional elements act as a conduit for the application of global norms and analyses both the relevance and effectiveness of the regional (and global) regimes in the Pacific context. The international legal framework for anti-corruption has primarily focused on the split between the ‘public’ and the ‘private’, a line which is often blurred in the small island developing States that make up the Pacific region. The anti-corruption regime also fails to provide a strong legal definition of ‘corruption’, relying on moral standards which remain fluid and ever-changing in both the international and regional contexts. This paper highlights the unique situation these elements place the region in, and explores the state of the international, regional, and national efforts to fight corruption. Overall, there is a significant inconsistency between the international legal framework and the regional and domestic, as well as a failure to appreciate the magnitude of resources required to implement the international standards against corruption. The framework for anti-corruption across the Pacific is incredibly fragmented, representing a considerable challenge to the region for ensuring its effectiveness. Corruption continues to remain a widespread problem for the region, however, there are several opportunities for development and progression in the regional anti-corruption regime.
