Abstract

While scholars have elucidated well the institutional roles of actors in early and high medieval judicial processesâprecisely what boni homines or witnesses or presidents of tribunals didâthe question of who these figures were as individuals, rather than as representatives of institutional categories, has been less well studied. This is in large measure because of the state of the evidence, which rarely provides useful information about any but the most prominent members of society. The relative density of the documentation from tenth- and eleventh-century Catalonia howeverâ1202 records in the PRJ database, out of a total of perhaps 20,000 surviving before the year 1100âallows for a proposopographical approach to judicial processes. The present chapter focuses on the possibility of âversatile participantsâ: individuals who served in different roles in different judicial processes. In particular, it explores the overlap between the roles of judge, scribe, saio, and mandatarius. Such overlap turns out to be quite rare, which suggests that in Catalonia judicial procedures were not the province of a limited number of experts responsible for all of the complexities. Many people knew, and were called upon to know, the rules of the legal game.
