Almost all suspects of the Democratic Republic of the Congo (DRC) and Uganda cases before the International Criminal Court (ICC) are allegedly responsible for using child soldiers. More than 90 victims participate in the case against Thomas Lubanga Dyilo. Among those are former child soldiers. But, the first decisions of the ICC seem to indicate that child applicants are confronted with particular difficulties: children struggle with providing the proof of their identity and age; uncertainties exist about their representation. These difficulties lead to the question of whether the ICC’s participation-mechanism takes sufficient account of the procedural peculiarities of child applicants?
